User Agreement

This agreement is between the church or organisation to which a Prezans serial number was issued ("you") and the makers of Prezans ("we", "us"). It covers the Prezans desktop application and the Prezans companion mobile application (the "Software"). By installing or using the Software you accept this agreement. The optional online services are governed by the Terms of Service.

1. Licence

In plain words: your church can use Prezans, in full and for free, on the number of computers your serial covers. Members of your church can use the companion app freely.

We grant you a non-exclusive, non-transferable, royalty-free licence to:

install and use the desktop application on up to the number of computers stated when your serial number was issued, for your church's worship, ministry and related activities; and
let members of your congregation, band and team install and use the companion application in connection with your church.

The Software is licensed, not sold. This licence is free of charge and does not expire, though it may be terminated as described below.

2. What you agree not to do

In plain words: don't sell it, don't pass your serial around, don't tamper with the activation.

No selling, renting, sublicensing or redistributing the Software or your serial number, and no offering the Software as a service to others.
No circumventing or attempting to circumvent activation or device limits.
No reverse engineering, decompiling or disassembling the Software, except to the extent applicable law expressly permits despite this term.
No removing or altering copyright and attribution notices.

Another church wants Prezans? Wonderful — send them to the request form so they get their own serial, free like yours.

3. Ownership and third-party software

We retain all rights, title and interest in the Software. The Software includes open-source components (including FFmpeg, licensed under the LGPL) whose licences and notices ship with the Software; nothing in this agreement limits the rights those licences grant you.

4. Your content

In plain words: what you put in stays yours — and clearing the rights for it stays your job.

The songs, media, audio and other content you import remain yours. We claim no rights over them. You are responsible for holding the rights or licences that your use of the content requires (for example CCLI cover licences for projected lyrics), and for what your church displays, records or broadcasts with the Software.

5. Updates

The Software may check for, download and install updates. Updates may add, change or remove features. You can decline an update by not installing it, though older versions may lose compatibility with the online services.

6. Privacy

The Software is offline-first and sends no analytics. What little the activation and the optional online services transmit is described in the Privacy Policy. Credentials for third-party streaming services (such as YouTube) are stored on your computer, not on our servers.

The Software itself never asks for an email address and never subscribes you to anything. If your church receives news from us, that is because somebody ticked the optional box on the request form on our website, and every such message carries a one-click unsubscribe link.

7. No warranty

In plain words: we build Prezans with care and run it in real services ourselves — but it comes without guarantees. Rehearse with your setup before the big day.

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT IT WILL MEET YOUR REQUIREMENTS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA OR CONTENT, ARISING FROM THE USE OF OR INABILITY TO USE THE SOFTWARE — INCLUDING A FAILED PROJECTION, RECORDING OR BROADCAST. WHERE LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE AMOUNT YOU PAID FOR THE SOFTWARE, WHICH IS ZERO.

9. Termination

This licence terminates automatically if you materially breach it. On termination you must stop using the Software and delete your copies. Your content is yours to export before you do — the Software's backup and export functions remain available. Sections 3, 4, 7 and 8 survive termination.

10. Governing law

This agreement is governed by the laws of the Republic of Mauritius, and any dispute is subject to the exclusive jurisdiction of the courts of Mauritius.
